After a loved one passes away, it will be necessary for that individual’s property to be passed along to heirs or beneficiaries. The transfer of this property can, in some situations, be quite complex, depending upon whether or not the individual had a will or other estate planning documents in place. This entire process is often referred to as probate, although the term “probate” really only applies to situations where the deceased did in fact have a will.

In probate, the court is taking steps to determine who is entitled to receive certain property, and what property belongs to the estate and is therefore able to be distributed to beneficiaries. Once these matters have been resolved, the administrator of the estate will be able to pass along property to those named in the estate planning documents.
